General terms and conditions of sale

Article 1 - GENERAL PROVISIONS - SCOPE OF APPLICATION

 


1.1 These General Terms and Conditions of Sale (“T&Cs”) set out the rights and obligations of the parties in relation to the online sale of products (the “Products”) offered by ECOMEDGE ADVISORY PTE. LTD. (the “Company”).


1.2 Any order placed on the website www.kossdesign.com (the “Website”) implies prior and unconditional acceptance of these T&Cs. These T&Cs form an integral part of the contract between the Customer and the Company (the “Contract”). They are enforceable against the Customer, who acknowledges having read and accepted them before placing an order.


1.3 These T&Cs apply to any order placed by an individual of legal age acting as a consumer. The Customer certifies that they are a natural person over 18 years of age and acting for purposes that are not related to any trade, business, craft, profession or agricultural activity. The Customer confirms they have legal capacity to enter into a contract and undertakes to provide accurate information.


1.4 Exclusion (B2B). These T&Cs do not apply to persons acting in a professional capacity. Professionals wishing to place an order are invited to contact the Company directly.


1.5 The version of the T&Cs applicable to each order is the one in force on the date of payment (or first payment in the case of multiple payments). The Company may amend these T&Cs at any time by publishing a new version on the Website.

 


 

 

Article 2 - CONCLUSION OF THE ONLINE CONTRACT

 


2.1 Ordering process

To purchase one or more Products, the Customer selects Products and adds them to their cart. After reviewing the cart and delivery details, the Customer validates the order, confirms they have read these T&Cs, and proceeds to payment.


Once payment is confirmed, the Customer receives an order confirmation by email containing the order summary and relevant information. The Customer expressly accepts receiving invoices electronically.


The Customer is strongly advised to keep the confirmation email and invoice as proof of purchase.


2.2 Refusal of order

The Company reserves the right to refuse or cancel an order for legitimate reasons, including, for example:

 

  • the order is not compliant with these T&Cs;

  • quantities ordered are inconsistent with normal consumer use;

  • non-payment of a previous order or an ongoing dispute;

  • suspicion of fraud supported by consistent evidence.

 

 


 

 

Article 3 - PRODUCT INFORMATION AND AVAILABILITY

 


3.1 Product information

The essential characteristics and prices of Products are made available on the Website. Illustrations, videos and photographs are for information only and do not form part of the Contract.


3.2 Availability

Product offers are subject to availability. Adding a Product to the cart does not guarantee availability.


If a Product becomes unavailable after an order is placed, the Company will inform the Customer by email and refund the unavailable Product (and any amounts paid for it). If the order includes other Products, those may be shipped and delivery charges may remain applicable.

 


 

 

Article 4 - PRICES

 


4.1 Displayed prices

Prices are shown on the Website in the currency displayed at checkout and are those in effect at the time the order is validated.


4.2 Taxes, duties and import charges 

Depending on the Customer’s delivery country and the shipping method used, taxes (including VAT and/or GST), customs duties and handling charges may apply.

Where applicable, and in particular where the Company is required or elects to collect GST or similar consumption taxes at checkout, such taxes will be collected by the Company and remitted to the relevant tax authority in accordance with applicable laws.

Where such taxes, duties or charges are not collected at checkout, they may be payable by the Customer upon import or delivery. The Company will make reasonable efforts to display relevant tax information at checkout where applicable.


4.3 Shipping costs

Shipping costs are indicated at checkout before payment and form part of the total price paid by the Customer.

 


 

 

Article 5 - PAYMENT

 


5.1 Timing

Payment of the total order amount is due immediately upon order confirmation unless an instalment option is explicitly offered at checkout.


5.2 Payment methods

The Customer may pay using the payment methods offered on the Website (e.g., credit/debit card, PayPal, vouchers or promotional codes). Payment is processed via secure payment service providers. The Customer confirms they have the authority to use the selected payment method.


The Company may suspend or remove any payment method at any time, in particular if a payment provider no longer offers the service or in case of a dispute.


Fraud prevention: the Company may request additional documents to verify an order where fraud is suspected. The order may be cancelled if verification cannot be completed.

 


 

 

Article 6 - DELIVERY - RECEIPT

 


6.1 Delivery

Before validating the order, the Customer is informed of available delivery methods and estimated delivery times. Delivery times are estimates and may vary due to carrier delays or customs processes.


The Customer is responsible for ensuring that delivery information provided is accurate. The Company is not responsible for non-delivery or delays caused by incorrect or incomplete address details.


6.2 Receipt and claims

Upon receipt, the Customer must check that the package and Products are complete and undamaged.


If the Customer notices an issue (missing item, damage, wrong item), they must contact customer service within 3 days of receipt, providing photos where possible, so the Company can investigate with the carrier or fulfilment partner.

 


 

 

Article 7 - RETURNS AND RIGHT TO WITHDRAW (COMMERCIAL POLICY)

 


7.1 Return window

The Company offers a 30-day return policy starting from the date the Customer receives the Product(s). For orders with multiple Products shipped separately, the period starts from the date the last Product is received.


Returns are accepted only for Products in original condition (unused, complete, with original packaging). For hygiene reasons, certain items may be non-returnable if opened or worn where applicable (this will be specified on the relevant Product page).


7.2 Return costs

Unless the return is due to the Company’s error (wrong item, defective item, or damage on arrival), return shipping costs are borne by the Customer.


7.3 How to request a return

To request a return, the Customer must contact customer service at support@kossdesign.com with:

 

  • order number;

  • Product(s) concerned;

  • reason for return;

  • photos if the Product arrived damaged or defective.

 


The Company will provide return instructions and, where applicable, a return address.


7.4 Refunds

Refunds are processed after the returned Products are received and inspected. Refunds are made to the same payment method used at checkout unless otherwise agreed.

 


 

 

Article 8 - WARRANTIES

 


8.1 Statutory rights

Nothing in these T&Cs limits the Customer’s mandatory rights under applicable consumer protection laws. In particular, the Company remains responsible where Products do not conform to the Contract, are defective, or where other statutory remedies may apply.


8.2 Commercial warranty (additional)

In addition to any statutory rights, the Company provides a free 6-month commercial warranty on bracelets, covering manufacturing or assembly defects under normal conditions of use.


This commercial warranty does not cover:

 

  • damage caused by misuse, accidents, improper care, or modifications;

  • exposure to chemicals;

  • normal wear and tear;

  • issues resulting from failure to follow care instructions.

 


To make a claim, the Customer must provide proof of purchase and contact support@kossdesign.com.


This commercial warranty is provided in addition to statutory rights and does not affect them.

 


 

 

Article 9 - PERSONAL DATA

 


The Company processes personal data in connection with orders and customer relationship management in accordance with its Privacy Policy and applicable data protection laws, including Singapore’s PDPA, and where applicable, GDPR for customers located in the EU/EEA.

Article 10 - INTELLECTUAL PROPERTY

 


All trademarks, domain names, products, software, images, videos, texts and other content on the Website are owned by the Company or its licensors and are protected by applicable intellectual property laws. No intellectual property rights are transferred to the Customer through these T&Cs.

 


 

 

Article 11 - FORCE MAJEURE

 


The Company shall not be liable for delays or failures to perform caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, strikes, supply chain disruptions, or carrier delays.

 


 

 

Article 12 - LIMITATION OF LIABILITY

 


To the maximum extent permitted by law, the Company shall not be liable for losses arising from improper use of the Products by the Customer, including modification or use not in accordance with care instructions.


Nothing in this article excludes liability that cannot be excluded under applicable law (e.g., fraud, wilful misconduct, or statutory consumer rights where applicable).

 


 

 

Article 13 - SUSPENSION / TERMINATION OF ACCOUNT

 


The Company may suspend or terminate a Customer account where the Customer breaches these T&Cs, commits fraud, or violates applicable law, without prejudice to any other rights or remedies.

 


 

 

Article 14 - RECORDS AND PROOF

 


Unless proven otherwise, records maintained by the Company (including electronic records) constitute evidence of transactions, communications, orders and payments.

 


 

 

Article 15 - SEVERABILITY

 


If any provision of these T&Cs is found invalid or unenforceable, it shall be deemed modified to the minimum extent necessary to make it enforceable, or severed if not possible, without affecting the remaining provisions.

 


 

 

Article 16 - GOVERNING LAW AND DISPUTE RESOLUTION

 


These T&Cs and any dispute arising out of or in connection with them (including non-contractual disputes) shall be governed by the laws of Singapore.


The parties agree to submit to the exclusive jurisdiction of the courts of Singapore, except where mandatory consumer protection laws of the Customer’s country of residence require otherwise.


Before initiating any formal proceedings, the Customer is invited to contact customer service at support@kossdesign.com so an amicable solution may be sought.

 


 

 

Article 17 - PROMOTIONS AND OFFERS

 


If an order benefits from a promotion based on a minimum spend or a minimum quantity and the Customer returns part of the order such that the eligibility conditions are no longer met, the refund amount will be adjusted accordingly.


Promotional codes:

 

  • cannot be combined unless explicitly stated;

  • apply only to eligible Products and according to the conditions displayed at checkout;

  • may not apply to items already on sale unless explicitly stated.

 


If a free gift or free shipping is provided based on a threshold and a return reduces the order below that threshold, the gift must be returned or its value may be deducted from the refund, and/or the original shipping cost may be deducted from the refund where applicable.
